International Seminar on the role of Supreme Courts

Professors Anna Nylund, Magne Strandberg and Camilla Bernt traveled to Leiden University to participate in a seminar organized by professor Bart Krans.

On the 15th to 16th February 2024, a group of researchers from various countries were invited to Leiden to discuss the role of Supreme Courts. The participants were, apart from the Netherlands and Norway, from Belgium, Japan, Spain, and Germany.

All three participants from Bergen gave presentations. Magne Strandberg dealt with the role of the Norwegian Supreme Court in appeals on access to evidence, Camilla Bernt dealt with the role of the Supreme Court in child protection cases in recent years, and Anna Nylund focused on the relationship between Alternative Dispute Resolution and the Supreme Courts. 

Discussions were fruitful, and significant differences between the systems emerged. For instance, the Appeals Selection Committee sets the Norwegian system apart from the others. In some of the countries present, the only form of gatekeeping to ensure that the Supreme courts’ resources are channeled to deal with suitable and important cases, is that the parties are required to find a lawyer with the right to appear for the Supreme Court to take on their case. Plans were made to further develop the contributions to articles and publish them in a combined publication.

At the end of the last day of the seminar, several Ph.D. students from the University of Leiden presented their Ph.D. projects. It was inspiring to see that one law faculty has recruited so many Ph.D. students with projects in the area of civil procedure law.
